Choice items sometime do not work

Happened to my δ Gardevoir and δ Haxorus,i think both times i missed the first attack or i attacked a substitute. Regardless,i am 100% this happened more than 1 time. After the bug takes place,you can use any of the 4 abilities anytime.
Can confirm that sometimes opponents hit my sub and were able to switch moves (1.2.3)
