Possible to change difficulty when supposed to be locked

I have noticed when the difficultyy is locked that through the main menu (so before loading the save) the difficulty can still be changed and works (I have tried out).

Maybe removing the difficulty setting from the main menu could make sense, and adding a difficulty setting when starting a newgame ?
