Spacing: part command defined, but not used

Parts automatically detected, but what if part command defined, but not used? how correct spacing? --> automatize?

This is a bit more tricky. The parts-option is intended for the correct spacing in the ToC, if parts are used in the document.

parts=false (correct spacing):

parts=true or default now (incorrect spacing):

I need to do some more testing on this...
