i cant use the latest version, it gives file is being used

i have overcome russian named video error by using -t option, but there is a bigger problem..i am using vista..but
2009.01.31 version works with no problem while latest 2009.5.13 or the tip versions give cannot access file error, claiming that the file it is trying to write is being used by another program even when i start with a clean directory and a clean directory with no files in it... i want to use the latest version since it has -w overwrtite skip option and fmt22.. please tell me whats wrong, i need to download a playlist quick before some of the videos been removed for some reason..it however creates the file with 0bytes size, but does not continue
