"send me updates" in signup doesn't work?

When you signup for the first time and check "send me updates", something goes wrong because after, when i go to edit my profile, i see the "newsletter" checkbox unchecked

This doesn't really makes sense at this point. Notifications must be controlled in a much smarter way than a simple checkbox.

This should be instead a check box to agree with the terms of service.
